Every time you make a phone call, stream a video, or browse the internet on your mobile, there’s a powerful regulatory body working behind the scenes to keep things fair, affordable, and competitive. That body is the Telecom Regulatory Authority of India (TRAI). Established in 1997, TRAI has been the cornerstone of India’s telecom revolution – overseeing the transformation of a government-controlled monopoly into one of the world’s largest and most competitive telecom markets. But what exactly does TRAI do, why was it created, and how does it impact the over 1.3 billion telephone connections in the country today?

Why was TRAI created?

Before 1997, India’s entire telecommunications sector was managed directly by the government through the Department of Telecommunications (DoT). The government was both the operator and the regulator – it ran the phone networks and also set the rules. This arrangement worked when telecom was a small, government-run affair. But the 1990s changed everything.

India’s economic liberalisation opened the telecom sector to private players. Suddenly, multiple companies wanted to offer services, and the old system of government-as-referee-and-player was no longer viable. Pricing disputes, regulatory gaps, and a lack of clear service standards emerged as serious problems. In a landmark observation, the Supreme Court of India in the Delhi Science Forum v. Union of India case emphasised the necessity of an independent statutory authority for a deregulated and competitive telecom market.

In response, the Indian Parliament passed the Telecom Regulatory Authority of India Act, 1997, and TRAI was formally established on 20 February 1997. Its core mandate: regulate telecom services – including tariff setting – which had previously been the sole domain of the central government.

The mission and objectives of TRAI

At its heart, TRAI’s mission is to foster the growth of telecommunications in India so that the country can play a leading role in the global information society. This is not just a vague aspiration. It translates into several concrete objectives that shape TRAI’s day-to-day work.

Enhancing tele-density

Tele-density refers to the number of telephone connections per 100 people in a given area. It is a key indicator of how connected a nation is. A higher tele-density means greater access to education, banking, healthcare, and government services for ordinary citizens.

TRAI promotes tele-density by creating policies that push telecom companies to expand their networks, particularly in rural and remote areas. These regions are typically more expensive to connect and less profitable for operators, so TRAI encourages infrastructure sharing, sets expansion targets, and works with mechanisms like the Universal Service Obligation Fund (USOF) to finance rural connectivity projects.

The results speak for themselves. According to TRAI’s annual report, India’s overall tele-density rose from 84.51% in March 2023 to 85.69% by March 2024. More recent data indicates that the wireless tele-density climbed to around 89.30% by February 2026, with the total subscriber base reaching approximately 1.32 billion. However, a significant urban-rural gap persists – urban wireless tele-density stands at over 142%, while rural wireless tele-density is around 58%.

Ensuring affordable access

India is known globally for having some of the lowest mobile data tariffs in the world. This isn’t an accident – it is largely the result of TRAI’s regulatory oversight. TRAI has the power to set, revise, and notify tariff rates for telecom services. By regulating pricing, TRAI ensures that basic telephony and internet access remain within reach for hundreds of millions of people, including low-income households.

This emphasis on affordability has contributed to massive data adoption. Average monthly data consumption per user jumped from just 0.27 GB in 2014-15 to over 20 GB by 2024, reflecting how accessible mobile internet has become for the average Indian consumer.

Promoting fair competition

One of TRAI’s primary goals is to maintain a level playing field for all telecom operators. Before TRAI, the government-run operator had an inherent advantage. Today, with multiple private and public players competing, TRAI ensures that no single company can dominate the market through unfair practices.

TRAI does this by setting terms and conditions for interconnection between service providers, regulating revenue-sharing arrangements, advising the government on spectrum allocation and pricing, and recommending the terms under which new licences are issued. If a telecom company fails to comply with its licence conditions, TRAI can even recommend licence revocation.

Protecting consumer interests

Perhaps TRAI’s most visible role is as a consumer champion. TRAI lays down quality of service (QoS) standards that every telecom operator must meet, conducts periodic surveys to check whether these standards are being maintained, and takes action against operators that fall short.

TRAI has also launched several consumer-facing initiatives over the years, including the DND (Do Not Disturb) app to block unsolicited commercial calls and messages, the MyCall app for reporting call quality, and the MySpeed app for testing data speeds. These tools give consumers direct power to hold their service providers accountable. TRAI also oversees the Mobile Number Portability (MNP) system, which allows users to switch operators without changing their phone number – a policy that has significantly increased competitive pressure among operators.

Structure and composition of TRAI

TRAI is headed by a Chairperson and includes up to two full-time members and two part-time members, all appointed by the Central Government. Members must possess expertise in areas like telecommunications, finance, law, management, or consumer affairs. The Chairperson holds the power of general superintendence and presides over TRAI’s meetings. Decisions are made by majority vote, with the Chairperson holding a casting vote in case of a tie.

The authority is supported by a secretariat headed by a Secretary, and its work is organised across several advisory divisions including mobile networks, broadband and policy analysis, quality of service, broadcasting and cable services, economic regulation, and consumer affairs.

Key powers and functions

TRAI’s functions, outlined in Section 11 of the TRAI Act, fall broadly into four categories:

Recommendations to the government: TRAI advises the central government on matters like the need for new service providers, licence terms and conditions, spectrum management, technology upgrades, and measures to promote competition. It is important to note, however, that TRAI’s recommendations are not binding on the government. If the government disagrees with a recommendation, it can refer it back to TRAI for reconsideration.

Regulatory functions: TRAI ensures compliance with licence terms, sets standards for quality of service, fixes conditions for interconnection between operators, regulates revenue-sharing arrangements, and maintains a public register of interconnection agreements.

Tariff regulation: TRAI has the authority to notify and revise the rates for telecom services provided within and outside India.

Information and investigation: Under Section 12 of the Act, TRAI can call upon any service provider to furnish information, appoint persons to conduct inquiries, and direct inspections of a company’s books of accounts. Under Section 13, TRAI can issue directions to service providers as it considers necessary.

The great separation: TRAI and TDSAT

In its early years, TRAI performed both regulatory and adjudicatory functions – it made the rules and settled disputes. This created a potential conflict of interest. How could TRAI impartially resolve a dispute about its own regulations?

This issue was addressed through the TRAI (Amendment) Act, 2000, which created a separate body called the Telecommunications Dispute Settlement and Appellate Tribunal (TDSAT). The primary purpose of TDSAT was to take over all adjudicatory and dispute resolution functions from TRAI, thereby strengthening the overall regulatory framework.

What does TDSAT do?

TDSAT handles disputes between a licensor (government) and a licensee, between two or more service providers, and between a service provider and a group of consumers. It also hears appeals against any direction, decision, or order passed by TRAI. Essentially, if a telecom company or a consumer group disagrees with a TRAI decision, their recourse is to approach TDSAT – not a regular civil court.

TDSAT is composed of a Chairperson (who must be or have been a Supreme Court judge or Chief Justice of a High Court) and two members. Its orders are enforceable like decrees of a civil court, and appeals against TDSAT orders can only go to the Supreme Court of India, and only on questions of law.

Why this separation matters

India’s institutional separation of regulatory and dispute resolution functions in telecom is considered a noteworthy model. It avoids the conflict of interest that arises when the same body that creates rules is also responsible for judging disputes about those rules. This separation has helped boost investor confidence, provided an avenue for faster dispute resolution, and maintained consistency in the application of telecom regulations. Over time, TDSAT’s jurisdiction has also expanded beyond telecom to cover broadcasting, cable services, airport tariff matters, and certain cyber-related disputes.

TRAI’s role in a changing landscape

TRAI’s mandate has evolved considerably since its inception. Originally focused on basic telephony and tariffs, it now oversees broadband, internet services, broadcasting, cable TV, DTH, and emerging areas like OTT (over-the-top) platforms and net neutrality.

In 2016, TRAI took a landmark stand on net neutrality by prohibiting discriminatory tariffs for data services, effectively blocking zero-rating platforms like Facebook’s Free Basics in India. This decision was widely praised as a victory for the open internet.

More recently, TRAI has been working on frameworks for 5G rollout, Wi-Fi access network architecture (WANI) to expand public Wi-Fi, and regulations for application-based linear TV distribution services. As India’s telecom sector grows to become the second largest in the world, TRAI faces the ongoing challenge of balancing affordability for consumers with financial sustainability for operators – especially as telecom companies make massive investments in new 5G infrastructure.

Challenges and criticisms

TRAI is not without its critics. One recurring concern is the extent of government control over the body. Under Section 25 of the TRAI Act, the central government can issue binding directions to TRAI. TRAI is also funded by the government, and its members are appointed by the government. This has led to questions about whether TRAI is truly as independent as the Supreme Court originally envisaged.

There have also been allegations of regulatory bias, particularly around the entry and rapid rise of certain telecom operators. Critics have questioned whether TRAI’s definitions and thresholds for market power were adjusted in ways that benefited specific companies. Additionally, the advisory (non-binding) nature of TRAI’s recommendations means the government can override the regulator’s expert opinion – a limitation that some argue weakens TRAI’s effectiveness.

Despite these criticisms, TRAI has played an undeniable role in enabling India’s telecom revolution. From a country with a few million phone lines in the late 1990s, India now has over 1.3 billion telephone connections and nearly a billion internet subscribers.

Summing up

TRAI operates at the intersection of technology, economics, and public policy. It is the institution responsible for ensuring that India’s vast telecom ecosystem remains competitive, affordable, and consumer-friendly. Through its regulatory oversight, tariff controls, quality-of-service standards, and the institutional separation of disputes via TDSAT, TRAI has built a framework that has helped India’s telecom sector grow at a remarkable pace. As the sector enters the era of 5G, AI-driven networks, and satellite-based connectivity, TRAI’s role as the silent architect of India’s digital infrastructure is only set to become more important.
